These Terms of Use (the “Agreement”) are between you and DQCLabs (“we”, “us”), the publisher of TouchBack. They apply to the TouchBack app for iOS and Android and to the website touchbacklove.web.app. By installing or using TouchBack you agree to them. If you do not agree, please do not use the app.
In short. TouchBack connects you with one person you invite. Be kind with it: only pair with someone who wants to be paired with you, and disconnect whenever you want to. Core touch is free; the free version shows some ads, never while the two of you are together in the Touch Room; TouchBack Premium is an optional subscription that each person buys for themselves. Subscriptions are billed and refunded by Apple or Google.
1. Who may use TouchBack
You must be at least 13 years old, or the minimum age of digital consent in your country if higher, to use TouchBack. If you are under the age of majority where you live, you may use it only with the involvement of a parent or guardian who agrees to this Agreement on your behalf.
2. Your connection
- One person, one connection. Each TouchBack identity can be paired with one other person at a time. Pairing happens only through an invitation that one of you creates and the other accepts.
- Invitations. An invitation link or code works once and expires. Share it only with the person you mean to pair with; anyone holding a valid invitation can use it.
- What your partner sees. Your partner sees your nickname, your profile photo and gender if you set them, whether you are in the Touch Room, your touch in real time, Knocks you send, and the history you create together, as described in the Privacy Policy.
- Disconnecting. Either person may disconnect at any time. Disconnecting ends the shared room immediately and your partner is told. What happens to shared history is explained in the Privacy Policy.
3. Acceptable use
You agree not to:
- pair with, or keep a connection with, someone who does not want it, or use TouchBack to harass, pressure, monitor or intimidate anyone;
- use repeated Knocks or notifications to disturb someone after they have asked you to stop;
- access or try to access another person’s identity, pair, recovery code or data;
- probe, scan, overload or interfere with our servers, the realtime service or other users’ connections, or bypass rate limits or security measures;
- reverse engineer, modify or tamper with the app to unlock Premium features, alter ads, or generate fraudulent ad impressions or clicks, except to the extent the law allows despite this restriction;
- use TouchBack for anything unlawful.
If you feel unsafe because of someone you are paired with, disconnect in Settings and, if needed, contact local authorities. You can also write to us and we will help.
4. Your identity and recovery
TouchBack has no login. Your identity is tied to your installation and protected by a secret stored securely on your phone. You are responsible for keeping your phone, your recovery code and any device-transfer code safe: anyone who has them can take over your place in your pair. We never ask for your recovery code. If you lose both your phone and your recovery code, we may be unable to restore your connection or history, and we are not responsible for that loss.
5. The licence we grant you
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use TouchBack on devices you own or control, for your own non-commercial use, under this Agreement and the rules of the store you obtained it from. TouchBack, its design, code, effects, haptic patterns, artwork and names are ours or our licensors’ and are protected by intellectual property law. You receive no rights except those expressly granted here.
6. Touch Prints, your photo, and what you share
Touch Prints and Recaps are generated from sessions you and your partner create together. You may save them and share them for personal, non-commercial purposes. Because they reflect a shared moment, please be considerate of your partner before sharing one publicly. When you share something outside TouchBack, the service you share it to is responsible for it under its own terms.
Your profile photo. If you add a profile photo, you confirm that you have the right to use it, and that it does not contain unlawful content or the image of someone who has not agreed to being shown. You keep ownership of it. You give us only the permission we need to store it and show it to the one person you are paired with, for as long as you keep it in the app — a non-exclusive, worldwide, royalty-free licence limited to that purpose. We do not use it for anything else: not for advertising, not for promotion, not to train anything. You can replace or remove it at any time from Settings → Profile, and removing it ends that permission and deletes the file. We may remove a photo that breaks this Agreement, and we will remove one if you ask us to.
7. The free version and advertising
Core TouchBack — pairing, Knock, live touch, basic haptics, Find Me and basic Touch Prints — is free. The free version shows ads served by Google AdMob. You may choose to watch an optional rewarded ad for a temporary cosmetic reward; a reward is granted only once the ad network confirms the ad was completed, and it expires as described in the app. Rewards have no cash value.
8. TouchBack Premium
TouchBack Premium is an optional subscription that adds premium effects, premium haptic patterns, room themes, Touch Print styles, unlimited history and Recaps. The exact list is shown on the Premium screen in the app and may change as features are added.
- Per person. A Premium subscription unlocks Premium features only for the person who bought it, on their store account. It is not shared with your partner; each person who wants Premium subscribes separately. Your partner may still see what you choose to share in the room, such as your touch trail or a room theme you set while your Premium is active. Disconnecting a pair does not change anyone’s subscription.
- Plans. Premium is offered as auto-renewing monthly and yearly subscriptions. Plans, their length and price are shown before you confirm, taken from the store.
- Payment. Payment is charged to your Apple ID or Google Play account at confirmation of purchase, under the store’s terms. We never see or receive your payment details. Prices are shown in your local currency and include any tax the store collects.
- Auto-renewal. The subscription renews automatically for the same period and at the same price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Free trials. If a free trial is offered, its length and the price that follows are shown before you confirm. Unless you cancel at least 24 hours before the trial ends, it converts into a paid subscription. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Managing and cancelling. Manage or cancel in your store account — on iPhone or iPad: Settings → your name → Subscriptions; on Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions. Deleting the app or disconnecting your pair does not cancel a subscription, and we cannot cancel one on your behalf. Cancelling stops the next renewal; Premium stays active until the end of the period already paid for.
- Refunds. Refunds are handled by the store you bought from, under its refund policy — Apple at reportaproblem.apple.com, Google through your Play Store order history. Where a statutory right of withdrawal applies to you, it is unaffected by this paragraph.
- Restoring purchases. Use Restore purchase on the Premium screen to restore a subscription after reinstalling or on a new device signed in to the same store account.
- Price changes. If we change the price of a subscription, the store notifies you in advance and, where required, asks for your consent before the new price applies.
9. Availability and changes
TouchBack relies on the internet, push notification services and our servers. Live touch, Knocks and presence may be delayed or unavailable because of network conditions, device settings, battery saving, or maintenance. Haptic feedback depends on your device’s hardware and may feel different, simpler or absent on some devices. We may update, change or remove features, and we may stop offering TouchBack; if we stop offering it while you have an active Premium subscription, we will give notice in the app and stop renewals.
10. Third-party services
TouchBack uses third-party services such as Supabase, Firebase, Google AdMob, RevenueCat, Apple and Google, described in the Privacy Policy. Their services are governed by their own terms, and we are not responsible for them. Ads shown in the app are provided by advertisers, not by us.
11. Suspension and termination
You may stop using TouchBack at any time by disconnecting and uninstalling the app. We may suspend or end your access, including disconnecting a pair, if you materially breach this Agreement — for example by harassing someone through the app, attacking our service, or tampering with it to unlock Premium. Uninstalling does not cancel a subscription; cancel it in your store account (section 8).
Sections that by their nature should survive termination do: intellectual property, disclaimers, limitation of liability and governing law.
12. Disclaimer
TouchBack is a way to feel closer; it is not an emergency, safety or medical service, and it must not be relied on to contact someone in an emergency. To the fullest extent permitted by law, the app is provided “as is” and “as available”, without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted, error-free, or compatible with every device. Nothing here excludes a warranty or right that cannot be excluded under the law that applies to you as a consumer.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or opportunity, arising out of or connected with your use of TouchBack. Our total aggregate liability arising out of or connected with this Agreement is limited to the greater of (a) the amount you paid for TouchBack Premium in the twelve months before the claim and (b) USD 50.
Nothing in this Agreement limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
14. Governing law and disputes
This Agreement is governed by the laws of Viet Nam, without regard to its conflict-of-laws rules, and the courts of Viet Nam have jurisdiction over any dispute. If you are a consumer resident in the EEA, the UK or another jurisdiction whose law gives you the right to bring proceedings in your own courts and under your own consumer law, this section does not take that right away. Please email us before starting anything formal.
15. Apple App Store terms
Where you obtained the app from the Apple App Store, the following applies and prevails over anything inconsistent above:
- This Agreement is between you and us only, not with Apple. We, not Apple, are solely responsible for TouchBack and its content.
- Your licence is limited to using the app on any Apple-branded product you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for TouchBack.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the app — including product liability claims, claims that it fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
- We, not Apple, are responsible for investigating and resolving any third-party claim that the app or your use of it infringes that party’s intellectual property rights.
- You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance, will have the right to enforce it against you.
16. Google Play terms
Where you obtained the app from Google Play, this Agreement is between you and us only. Google is not a party to it and is not responsible for TouchBack. The Google Play Terms of Service apply to your download and to any purchase made there, and Google’s refund policy governs any refund.
17. General
- Entire agreement. This Agreement and the Privacy Policy are the whole agreement between us about TouchBack.
- Changes. We may update this Agreement. For material changes we will give notice in the app or on this site before they take effect; continuing to use TouchBack afterwards means you accept them.
- Severability. If a provision is held unenforceable, the rest stays in force.
- No waiver. Not enforcing a right straight away is not a waiver of it.
- Assignment. You may not assign this Agreement. We may assign it as part of a merger, acquisition or sale of assets, on notice to you.
- Standard EULA. This Agreement is the end-user licence agreement for TouchBack. Where you obtained the app from the Apple App Store and this Agreement is silent on a matter, Apple’s Licensed Application End User License Agreement applies to it.
- Language. This Agreement is written in English. Any translation is provided for convenience only; the English text prevails.
What changed in version 1.1
- Section 6 now covers the profile photo you upload: that you must have the right to it, that you keep ownership, the narrow permission you give us to show it to your partner, and how to remove it.
- Added a link to the data deletion page.
- 28 September 2026: the summary now says where ads never appear — while the two of you are together in the Touch Room — rather than “outside the Touch Room”.
